Restricting active legal capacity

In accordance with subsection 8 (2) of the General Part of the Civil Code Act, adults who due to mental illness, mental disability or other mental disorder are permanently unable to understand or direct their actions have restricted active legal capacity. Therefore, information on restricting a person’s active legal capacity (including the fact itself) presents information on the person’s state of health or disability, which qualify as sensitive personal data in accordance with clause 4 (2) 3) of the Personal Data Protection Act. According to the Personal Data Protection Act, administrators of sensitive personal data must register the administration of sensitive personal data with the Data Protection Inspectorate.
